Governor Brown has declared a State of Emergency in Napa, Sonoma, Yuba, Butte, Lake, Mendocino, Nevada and Orange counties. More counties are expected.

Evacuations have also been issued for parts of Solano County near Fairfield.

IRS

Filing and payment deadlines disaster relief is available for taxpayers in disaster areas.  It is not required that a taxpayer be in a “declared” disaster area to be an “affected taxpayer.” Taxpayers are “affected” if records necessary to meet a filing or payment deadline postponed during the relief period are located in a covered disaster area. The location of your tax preparer may also entitle you to relief.  However, it is necessary to call the IRS Disaster Relief Hotline at 866-562-5223.

FTB

We confirmed this morning with the  FTB Practitioner Hotline that the information on the disaster loss page is applicable to the current fire related disasters in California and will be updated once FTB has had a chance to process the Governor’s emergency declaration dated October 9.  The extended deadline to file and pay for FTB is January 31, 2018 unless further extended.  Please take note that it is necessary to write in RED ink at the top of the return the name of the fire and the county. This FTB page states that California conforms to the IRS regarding disaster relief generally.

EDD  60-Day Extension Request

Employers may be able to request up to a 60-day extension of time to file their state payroll reports: and/or deposit state payroll taxes without penalty or interest.  The Employment Development Department (EDD) must receive written requests for extension within 60 days from the original date of the return or payment.  The EDD website does not currently list the September and October fire disaster counties as included in this relief.  Once EDD has processed the Governor’s emergency declaration dated October 9, we would expect that the affected counties would be included.
